Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Artist.FM (the “Service”), operated by ArtistFM LLC, a limited liability company organized in New Mexico, USA (“Artist.FM,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Artist.FM helps independent musicians identify relevant playlist curators, draft and personalize outreach emails, send those emails from your own connected email account, and track replies. The Service is currently offered in a private beta and may change, and features may be added or removed, over time.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.

3. Connecting your email account

The Service can connect to your Google (Gmail) account to send outreach and detect replies, as described in our Privacy Policy. You authorize us to send email and read campaign replies on your behalf, at your direction. You can disconnect your account, and revoke our access, at any time from Settings. You are responsible for complying with your email provider’s terms (including Google’s) when using the Service.

4. Acceptable use and anti-spam

Email you send through the Service is sent from your own account and is your responsibility. You agree that you will:

  • only contact recipients you have a legitimate basis to contact, and comply with all applicable laws, including the U.S. CAN-SPAM Act, the EU GDPR and ePrivacy rules, Canada’s CASL, and any other laws that apply to your outreach;
  • not send unsolicited bulk email (“spam”), deceptive subject lines, or false header information;
  • promptly honor unsubscribe and opt-out requests, and not contact anyone who has opted out. We provide unsubscribe tooling (including one-click list-unsubscribe headers and an opt-out management page), but you remain responsible for honoring opt-outs;
  • not use the Service to harass, defraud, impersonate, or infringe the rights of others, or to transmit unlawful, harmful, or malicious content.

We may suspend or terminate accounts that we reasonably believe are using the Service to send spam or otherwise violate these Terms. We are not the sender of your email and are not responsible for the content you choose to send or the recipients you choose to contact.

5. AI-generated content

The Service uses AI to help draft and personalize your emails. AI output can contain errors or inaccuracies. You are responsible for reviewing all content before it is sent, and for ensuring it is accurate, appropriate, and lawful. You review and approve outreach before it is sent.

6. Fees

The Service is currently provided free of charge during private beta. We may introduce paid plans in the future; if we do, we will present pricing and terms before you incur any charge.

7. Intellectual property

The Service, including its software, design, and content we provide, is owned by Artist.FM and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of the content you create (such as your outreach messages); you grant us the rights necessary to operate the Service and to send and process that content on your behalf.

8. Third-party services

The Service integrates with third parties (including Google, Spotify, and others described in our Privacy Policy). Your use of those services is governed by their own terms, and we are not responsible for them.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that using it will result in playlist placements, replies, or any particular outcome.

10. Limitation of liability

To the maximum extent permitted by law, Artist.FM and its owners and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim, or USD $100.

11. Indemnification

You agree to indemnify and hold harmless Artist.FM and its owners and providers from any claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, the email you send through it, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. On termination, your right to use the Service ends; provisions that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive. Deleting your account deletes your data as described in the Privacy Policy.

13. Governing law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state and federal courts located in New Mexico, unless applicable law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date above and, for material changes, provide additional notice where appropriate. Continued use of the Service after changes take effect constitutes acceptance.
